Apply for a Right-of-Way Permit

A right-of-way permit is required for all work in the right-of-way including but not limited to:

Any excavation work is being done within the public right-of-way
Overhead, at grade, and underground utility work
Any work that requires traffic control
Any work that requires pre-placement inspections (typically drive approaches and sidewalks)

The public right-of-way typically starts approximately 11 ft. measured from the back of the curb.

Application

Application to accomplish the proposed work is made under the terms of the Ordinances and Specifications of the City of Olathe, Kansas, governing excavation and/or construction within the public right-of-way. Applicant agrees to perform said work and restoration of right-of-way in accordance with the provisions of said City Ordinances and Specifications and further agrees to satisfactorily repair any failure or damage within the right-of-way resulting from the excavation or construction covered under the permit within one year thereafter.

Permit Requirements

Sketch or drawings of proposed work to scale. Show the location of proposed work. (See Right of Way manual for minimum drawing requirements)
$1,000 Right-of-Way Performance and Maintenance Bond submitted to the City of Olathe to be maintained for one year from date of accepted work. Residential drives are exempt.
Detailed and site-specific traffic control plan, if work requires a traffic detour or lane closure.
Traffic staff must be notified at 913-971-5180 a minimum of 48-hours in advance if there are temporary lane reductions or closures. Pre-placement inspections (typically sidewalk and drive approaches in the right-of-way) must be scheduled a minimum of 24-hours in advance via the online permit portal.
Contractors shall install door hangers or notification yard signs on all properties immediately adjacent to area where work is being performed.
Restoration of the area in accordance with provisions of the Olathe Municipal Code and Technical Specifications.
Permits are valid for 60 days. A permit extension of 60 days may be requested. Fees assessments will apply for areas of unfinished work and areas of incomplete restoration.

Small Cell Information

Co-location of small cell sites on City streetlights shall include the following in the permit application:

The Contractor shall submit a complete schedule of materials and equipment proposed for installation. This schedule shall include catalog cuts, diagrams, drawings, and other data as may be required. In the event any material or equipment contained in the schedule fail to comply with specification requirements, such items may be rejected.
In lieu of submitting catalog cuts, the Contractor may utilize pre-approved materials as shown on the City of Olathe Approved Materials List. The Contractor shall then list the materials from the pre-approved list that are proposed for use and submit to the City for approval.
